HOMEOWNER ACKNOWLEDGEMENTS:
A. I (the homeowner) am responsible for obtaining all necessary permits.
B. I understand that no construction activity shall take place prior to the approval of the ACC. The ACC will take
a minimum of 72 business hours and a maximum of 30 days to approve the project. If alterations are made
prior to approval I may be required to return to the property to its formal conditionat my own expense if the
application is not approved wholly, or in part, and that I may be required to pay all legal expenses incurred
if legal action becomes necessary.
C. I am aware of the Community, County, and State, Covenants, Conditions and Restrictions, Design Guidelines,
Rules and Regulations, and Architectural Controls of the community with regard to the application and review
process.
D. I understand that any approval is contingent upon construction or alterations being completed in a workman
like manner as per plans submitted.
E. The approval by the ACC shall not be constructed as a representation, warranty, or assurance by the ACC or
the Devleoper that the proposed improvements comply with applicable statutes, laws, ordianances, codes,
rules, regulations, and requirements and shall not constitute the assumption of any liability on ACC (Noah's Architectural Control Committee (d.b.a. Noah's ARC), or the Developers part for the accuracy or compliance
with such statutes, laws, ordinances, codes, rules, regulations, and requirements.
F. I am aware that I am responsible for obtaining perosnal and property insurance suffucient for adequate
coverage for this, and any other home project.
G. I agree that I am responsible for any damages, alterations, etc. to my neighbor's, and the HOA property, that may result from this project and agree to bring the damaged property back to it's original state prior to the
project start. Access through the Association's common areas and easement areas for construction purpose
is is not allowed without prior written approval of the Association Board of Directors.
H. I have signattures of my immediate neighbors that will be affected by the project (not renters or contractors.)
I. If relief from a Covenant Restriction(s) is needed, a request for avarance must be included in packet.
H. Review Process: The standards for approval of all requests shall include, but are not limited to: 1.) aesthetic
consideration; 2.) materials to be used; 3.) compliance with the design standards adopted by the Board,
4.) harmony with the external design of the existing dwellings, lots, and structures surrounding the dwelling;
5.) any other matter deemed to be relevant by the ACC.
I. Appeals: The Association allows appeals of an ACC Commission decision. Appeals must be submitted in writing
to the ACC / BOD in accordance with the Association's governing documents
